MONGABAY’s just reported on latest CCAMLR’s decision about the South Antarctic krill and other species fisheries, which can be read here.

It basically follows past years’ CCMLR meetings outcome, with the krill fishery facing most of the scrutiny. None of the effort made by all the stakeholders involved in this fishery, science included, seems to be taken into consideration by the same scientific community. It is not only world’s best managed fishery, but also the one having the largest areas of either protected, or no-fishing activities. 

Future annual meetings will be much more contested, possibly the consensus-decision taking approach scraped, and the entire South Antarctic well balanced science-commercial activities clashing each other. Even more when the coming revision of the original Antarctic Treaty is re-visited.

Some frenzy years have passed for South Korean consumers dealing with poor-quality (read false) krill oils. Not only blended (read not pure) krill oils, but also oxidized ones. 

Latest from the South Korean Ministry of Food and Drug Safety (MFDS) found that almost all of their last krill oil recalled brands were USA-made. It is bad for krill oils, but also raises the risk to taint the entire Omega-3 category.

Dear Friends

A 2020 paper contributes to mapping the scientific and patent landscape for biodiversity and innovation in Antarctica and the Southern Ocean. It reviewed 116 million patent documents and 64 million families from 134 countries. Europe and USA lead the list of invention patents holders, Tharos ranking 3rd regarding patents family members.

When the data is ranked by species and the number of scientific publications, krill leads thanks to a combination of an increasing number of claims to elements of krill, such as krill oil, and the use of krill as an actual or potential ingredient in a claimed invention, such as a foodstuff, animal feed, pharma or cosmetic. 

The proliferation of patent activity across sectors for krill and its implications, predict trends in the krill fishery. Across both scientific and common names for krill, the report identified 150 first filings linked to a total of 1.193 family members worldwide.

We appreciate consumer’s eagerness to learn about krill oil, South Korean krill oils recalled brands, how to make a wise purchase, and distinguish real vs. faked krill oil brands. Above all, how we all protect this category from wrongful business practices.

Well… identifying such wrongful activities is not an easy task.

Our July 12^th newsletter addressed the brands recalled by KFDA. Thanking RIMFROST, we are clarifying the who’s who on the public photo that put together a recalled brand (JW58), a non-recalled brand (JW100) and RIMFROSTS’s FOS certificate. It is the non-recalled brand (JW100) that used RIMFROST’s oil.

We are referring to JW Pharma. Korean public info indicates that JW krill oil (abbreviation and brand name for Choongwae Pharmaceutical) was produced with krill oil supplied by Ju Yeong NS.

It is a mid-sized Korean pharma company. Their krill oils are not shown on their product listing. Their products they sell were listed at NAVER (typing 중외제약 크릴오일.) 

JW Pharma’s JW58 was published by KFDA using Krill Oil from AMF Pharma LLC (AMF). AMF krill Oil is used by other brands also notified by KFDA.  

Canadian AMF Pharma does not display krill oil among their product portfolio. AMF’s KFDA import data shows no krill oil imports since 2020. 

Our same July 12^th newsletter also addressed krill oil manufactures as almost sole FOS-registered companies. As a matter of fact, FOS registry has not only direct krill oil manufacturers, but a large number of intermediate companies.

Non-direct krill oil producers can buy krill oil (or any other krill product) from a FOS-certified factory trawler (or on-land krill oil manufacturer ), and then, would that be the case, re-process the oil to manufacture their own nutraceutical/supplement branded product, which will adhere to their FOS-registered krill oil supplier.

Several of these intermediate companies are third-party certified to prove compliance with the chain of custody and product traceability.

Hence, buying krill oil from a direct manufacturer that is FOS-certified, it goes all along the value chain to the final seller, indicated in the product traceability, and the label.

As you can see, the krill oil ecosystem is composed of few oil producers, and a handful number of intermediate companies down the value chain, offering their own branded krill oils. Some blend with vitamins … and so on.

When a krill oil manufacturer sells in good faith its krill oils, and the intermediate company decides to blend such oil with other non-krill material for example, how the former keeps control of its offering? What to do?

A question to answer.
